1. Introduction

1.1 These Terms and Conditions (“Terms”) govern the sale and supply of products by The Banks Tea Company Ltd, a company registered in England and Wales (Company No. 14907018) (“Banks Tea”, “we”, “us”, “our”), to customers (“Customer”, “you”) via our online shop at www.bankstea.com (the “Online Store”).

1.2 By accessing or using the Online Store, you agree to be bound by these Terms. If you do not agree, you must not use the Online Store.

1.3 We may update these Terms from time to time. The latest version will always be available on our website.

2. Use of the Online Store

2.1 To place orders, you may be required to register an account via our secure portal.

2.2 You are responsible for maintaining the confidentiality of your login details and for all activity under your account.

2.3 You must ensure that all information you provide is accurate and complete.

2.4 You agree not to misuse the Online Store or use it for unlawful purposes.

2.5 Your use of the Online Store is at your own risk, except where loss arises from our negligence or where liability cannot be excluded under law.

3. Definitions

• “Order”: a request submitted by you to purchase Products
• “Products”: tea, merchandise, events, or other items sold via the Online Store
• “Confirmation Email”: our email confirming acceptance of your Order
• “Contract”: the agreement formed when we accept your Order

4. Orders and Contract Formation

4.1 All Orders are subject to acceptance by us.

4.2 An Order is only accepted when we send you a Confirmation Email. At this point, a legally binding Contract is formed.

4.3 We reserve the right to refuse or cancel any Order for any reason, including product unavailability or pricing errors.

4.4 If we cannot fulfil your Order, we will notify you and offer a refund or alternative where possible.

4.5 Payment must be made in full at the time of placing an Order using an approved payment method.

4.6 Ownership of Products passes to you once full payment has been received.

4.7 Risk in the Products passes to you upon delivery.

5. Prices and Payment

5.1 All prices are shown in GBP (£) and include UK VAT where applicable.

5.2 We take reasonable care to ensure pricing is accurate; however, errors may occur.

5.3 If a pricing error is identified, we will contact you to offer the option to proceed at the correct price or receive a refund.

5.4 We reserve the right to change prices at any time before an Order is accepted.

6. Delivery

6.1 Delivery costs and estimated delivery times will be shown at checkout or in your Confirmation Email.

6.2 We will use reasonable efforts to deliver within the estimated timeframe, but delays may occur due to circumstances outside our control.

6.3 We are not responsible for delays caused by courier services, customs, or events beyond our control. This does not affect your statutory rights.

6.4 If delivery fails due to incorrect information or inability to receive the parcel, additional charges may apply.

6.5 You are responsible for ensuring delivery instructions are accurate. We are not liable for loss resulting from incorrect delivery instructions provided by you.

7. Returns, Refunds and Cancellation

7.1 Under the Consumer Contracts Regulations 2013, you have the right to cancel your Order within 14 days of receiving your Products.

7.2 To exercise your right to cancel, you must notify us within this period and return the Products within 14 days.

7.3 Products must be returned in a resaleable condition. Refunds will be issued within 14 days of receiving returned goods.

7.4 Due to hygiene and safety reasons, tea and other consumable products cannot be returned once opened, unless they are faulty or not as described.

7.5 You are responsible for return shipping costs unless the Product is faulty, damaged, or incorrect.

7.6 If Products are defective or not as described, you are entitled to a full refund or replacement within 30 days of delivery, in accordance with the Consumer Rights Act 2015.

8. Product Information and Disclaimer

8.1 We take care to ensure all Product descriptions are accurate; however, they are provided for guidance only.

8.2 Our teas may be processed in environments that handle allergens. Please review product information carefully.

8.3 Our Products are not intended to diagnose, treat, or cure any medical condition. Always seek professional advice where necessary.

9. Promotions and Tea Club

9.1 Promotional offers and Tea Club benefits are subject to availability and specific terms.

9.2 Promotional codes must be applied at checkout and cannot be applied retrospectively.

9.3 Offers are limited to one per Customer unless stated otherwise and cannot be exchanged for cash.

9.4 We reserve the right to amend or withdraw promotions at any time.

10. Complaints

10.1 If you have a complaint, please contact us at info@bankstea.com with your order number and full details.

10.2 We aim to acknowledge complaints within 5 working days and resolve them within a further 5 working days where possible.

11. Liability

11.1 Nothing in these Terms excludes or limits liability for:

• death or personal injury caused by negligence
• fraud or fraudulent misrepresentation
• any matter which cannot be excluded under UK law

11.2 We are not liable for indirect or consequential losses, including loss of profit or business.

11.3 Our Products are intended for personal use only. We are not liable for any business losses.

11.4 Our total liability shall not exceed the amount paid for the Products in question.

12. Data Protection

12.1 We process personal data in accordance with our Privacy Policy, available on our website.

13. General

13.1 These Terms are governed by the laws of England and Wales.

13.2 You agree to the exclusive jurisdiction of the English courts.

13.3 No third party shall have rights under the Contracts (Rights of Third Parties) Act 1999.
